Introduction
Welcome to Ridefer, a peer-to-peer car-sharing platform connecting car owners with individuals seeking flexible and affordable mobility solutions in the Tri-State area (New York, New Jersey, and Connecticut). These Terms & Conditions (“Terms”) govern your use of the Ridefer website, platform, and mobile applications (collectively, “Ridefer”).
By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our platform.
Definitions:

- “User” refers to any individual using the Ridefer platform, including renters and car owners.
- “Renter” means a person booking a vehicle through the platform.
- “Host” or “Owner” refers to a person listing a vehicle on Ridefer.
- “Trip” means a confirmed car rental booking between a host and a renter.
User Eligibility
To use Ridefer as a renter or a host, you must meet the following criteria:
Renters Must:

Own or have legal rights to list the vehicle.

Ensure the vehicle is in safe, legal operating condition.

Provide accurate vehicle information (photos, VIN, insurance).

Comply with all local, state, and federal regulations.

Be at least 21 years of age (additional restrictions may apply by state or vehicle type).

Possess a valid driver’s license issued in the U.S. (and meet our internal verification requirements).

Have a clean driving record, free of major violations.

Provide valid payment information and pass identity verification.
Rental Agreements
By booking or listing a trip through Ridefer, you agree to the following:

Accurate Information
All users must provide accurate, up-to-date personal and vehicle information. Misrepresentation may lead to suspension or permanent ban from the platform.

Respectful Behavior
All users must behave respectfully during interactions—both online and in person. Abusive language, harassment, or threatening behavior is strictly prohibited.

Vehicle Care
Renters are expected to return vehicles in the same condition they received them, including cleanliness and fuel levels. Smoking, unapproved pets, or reckless driving may result in cleaning or damage fees.

Reporting Incidents
Any accidents, damages, or disputes must be reported to Ridefer within 24 hours. Failure to report may affect eligibility for insurance coverage or refunds.

Compliance with Laws
All users must comply with local, state, and federal traffic laws. Illegal activity or unlicensed driving will result in immediate suspension and possible legal action.
Insurance & Liability
Coverage Overview
All trips on Ridefer are protected under a third-party insurance policy. This coverage includes liability, physical damage, and theft protection, subject to policy terms.
Renter Responsibilities
Renters are responsible for any deductibles and damages not covered by insurance. Optional protection plans may be offered at checkout to limit out-of-pocket costs.
Owner Coverage
Vehicle owners are covered under Ridefer’s partner policy during active bookings. Owners must ensure their personal insurance allows for car-sharing participation.
Limitation of Liability
Ridefer is not liable for indirect damages, loss of income, or third-party claims resulting from use of the platform. Our liability is limited to the amount paid by the user for the transaction in question.
Claims Process
In the event of an accident or damage, users must follow the Ridefer claims process, including providing photos, a police report (if applicable), and timely submission of required documentation.
Platform Rules & Prohibited Use
Acceptable Use Policy
Ridefer users must utilize the platform solely for legal, authorized purposes. All actions must comply with applicable laws and Ridefer policies.
Prohibited Activities Include (but are not limited to)
- Listing or renting vehicles not personally owned or legally authorized.
- Providing false or misleading user or vehicle information.
- Tampering with or disabling Ridefer’s app, software, or security systems.
- Using a rented vehicle for racing, towing, off-roading, or commercial deliveries unless explicitly authorized.
- Transporting illegal substances, weapons, or engaging in unlawful activities.
- Allowing unauthorized persons to drive during the rental period.
Platform Integrity
Any attempt to manipulate reviews, impersonate other users, or bypass platform fees is a violation and may lead to immediate suspension or legal action.
Termination of Access
Platform Integrity
Ridefer reserves the right to suspend or terminate user access to the platform at any time for:

Breach of these Terms & Conditions.

Unsafe driving or repeated vehicle misuse.

Non-payment or fraudulent activity.

Repeated cancellations, disputes, or negative feedback.
By User
Users may terminate their Ridefer account at any time by submitting a request via the platform. All active reservations must be completed or canceled prior to account deactivation.
Effect of Termination
Upon termination, access to the platform will cease immediately. Ridefer may retain certain user data in accordance with privacy and legal requirements.
Dispute Resolution & Governing Law
Informal Resolution
In the event of an accident or damage, users must follow the Ridefer claims process, including providing photos, a police report (if applicable), and timely submission of required documentation.
Arbitration Clause:
If unresolved, disputes between users and Ridefer will be submitted to binding arbitration in the State of New York, in accordance with the American Arbitration Association (AAA) rules. Users agree to waive the right to class-action suits or jury trials.
Governing Law
These Terms & Conditions are governed by and construed under the laws of the State of New York, without regard to conflict of law principles.
Jurisdiction
Users consent to the jurisdiction and venue of courts located in New York County, NY, for any claims not subject to arbitration.
Changes to Terms
Right to Modify Terms
Ridefer reserves the right to modify, update, or revise these Terms & Conditions at any time. Users will be notified of significant changes via email or through the platform. Continued use of the platform after such changes constitutes acceptance of the revised terms.
User Responsibility
